K Mart Woes


Misleading Sign?

Just had a very exhausting hour at K Mart over the road. They had this special on, 2 Playstation 2 games for $40, but only on selected titles. But they have a sign stuck on the shelf that just makes it look like ALL the Platinum games are 2 for $40. In very small letters it says “selected titles only” but that’s it. So Ned thought they were all on special, took 4 up to the counter, said something about “misleading advertising”, the guy called the manager and the manager said “okay then, you can have them for 2 for $40″!! Joy for Neddles.

So then he returns and persuades me to try and do the same thing (naughty!) but the counter guy and we think the manager must have changed, as there was just no way. Ned got very frustrated and even made the manager come down to Sound & Vision and look at the sign, but she wouldn’t budge. It was very misleading but maybe legal - but maybe not! I have uploaded the photos, please, post your comment as to whether it is legal or not. Note the very small biro writing on the close up of the sign.

    Medal Of Honour Frontline, World Rally Championship II, LOTR: The Two Towers, and Crash Bandicoot Wrath of Cortex… And I had picked out GT3, Fifa 2003, The Getaway and Splinter Cell. Wah!

    …and yes, that sign is very misleading at first glance. altho loophole legal aspect would be that if it does have fine print, they are covered :( me thinks

    nice goin to the nedster, but sadly as an ex-retail slave, i can tell you that as long as it says “selected items only” or whatever, (no matter how small, crappily written and in an odd little place) then the shop can tell you to… uh, ‘get stuffed’. i know this cos at virgin (where i used to slave) we ALWAYS had this problem. the reasoning was that most people will get to counter with their full-priced goods-that-were-racked-out-amongst-bargain-ones and when they got told they were wrong they would just but em anyway cos A) by that time they really wanted them and B) most people can’t be bothered arguing or are too chicken. BUT NOT YOUSE FULLAS AYE??? like i said, nice one! xxx
